Limited Scope Representation Agreements

Illinois law, in an effort to give its citizens with lower incomes or reduced resources greater access to legal representation, has moved to expand and detail the terms of Limited Scope Representation (LSR) and the requirements of the agreements made between attorneys and clients. If you or someone you know is in need of legal services, but have limited resources on which to draw to cover the expense of a full service attorney, you may benefit from a LSR contractual arrangement with skilled LSR attorney.

Limited Scope Representation Agreements

No one wants to be forced to be forced to obtain and pay for services that they do not want. But, when it comes to divorce it may be prudent to hire a lawyer, even on a limited basis. When the attorneys at Kathryn L. Harry & Associates, P.C. meet with you to discuss the legal options you have in your case, we will detail the scope of legal representation we will provide to better protect your rights and to facilitate the most favorable outcome possible. Based upon our assessment of the your legal situation, the legal matters you want addressed, and the legal options available to you, we will determine if Limited Scope Representation is your best option. In our LSR arrangement, we will develop a written agreement that will define the parameters of our limited scope relationship. The agreement will:

  • Spell out the extent of duties and tasks to be performed by your attorney, including a list of attorney prepared documents, and client-prepared documents to be drafted and reviewed;
  • Detail the extent of duties and tasks to be handled by you, the client;
  • Explicitly set forth the limitations of your attorney’s representation so there are no unexpected surprises on your bill;
  • Define the timeline for the implementation of the services outlined agreement, including the part of the legal work that you plan to do; and
  • Specify the flat fee schedule or hourly rate for all law office staff involvement.

In forming a LSR arrangement with our attorneys, before signing the agreement, you should review it thoroughly, ask as many questions as you need to before signing, or perhaps have it reviewed by another attorney. It is important to note, that in a LSR agreement, the lawyer will not provide more legal representation than is spelled out in the agreement, nor are you financially liable for any additional time spent on your file or services the lawyers perform on your behalf outside of the parameters of the agreement.
