For a Class A misdemeanor DUI, the state can impose the following penalties:

  • For a second offense - A mandatory minimum term of either five days of imprisonment or 240 hours of community service, suspension of vehicle registration, and revocation of driver's license for five years.
  • First offender DUI while transporting a child under the age of 16 - An additional six months of imprisonment, an additional mandatory $1,000 fine, and 25 days of community service in a program benefiting children.
  • First offender DUI with BAC of 0.16% - A mandatory minimum of 100 hours of community service and mandatory minimum $500 fine.
  • Second DUI with BAC of 0.16% - A mandatory two days in jail and mandatory minimum $1,250 fine.
