Repeat and Felony DUI Penalties in Illinois

Charges and penalties for a misdemeanor DUI charge may be upgraded to an aggravated felony DUI when you:

  • Drive on a suspended or revoked license for a prior DUI - Class 4 felony, up to $25,000 fine and one to three years of incarceration.
  • Have two or more previous DUIs - Class 2 felony, up to $25,000 fine and three to seven years of incarceration.
  • Are involved in an accident that resulted in bodily harm to a passenger under age 16 - Class 4 felony, one to three years prison, up to $25,000 fine, plus an additional mandatory $2,500 fine, and 25 days of community service.
  • Drive with no valid driver's license - Class 4 felony, 1-3 years incarceration;
  • Drive in an uninsured vehicle - Class 4, up to $25,000 fine and one to three years of incarceration.
  • Cause an accident resulting in disfigurement or permanent disability - Class 4 felony, up to $25,000 fine and one to three years of incarceration, plus license revocation for a minimum of two years.
  • Cause an accident resulting in a fatality - Class 2 felony, up to $25,000 fine and three to seven years of incarceration, plus license revocation for a minimum of two years after release from prison.
  • Drive a school bus with passengers under 18 years of age on board - Class 4 felony, up to $25,000 fine and one to three years of incarceration.
  • Drive a vehicle for hire while carrying passengers - Class 4 felony, up to $25,000 fine and one to three years of incarceration.
  • Drive in a school zone while a restricted speed limit is in effect and involved in an accident which caused great bodily harm - Class 4 felony, up to $25,000 fine and one to three years of incarceration.

With repeat DUI felony charges, special circumstances and expanded penalties are incurred. These penalties are in addition to any other criminal or administrative sanctions for DUI and include:

  • Third DUI - Class 2 felony, three to seven years of incarceration, revocation of driver's license for 10 years; with 0.16 BAC - mandatory minimum $2,500 fine.
  • Fourth DUI - Class 2 felony, three to seven years of incarceration, revocation of driver's license for life; with 0.16 BAC - mandatory minimum $5,000 fine.
  • Fifth DUI - Class 1 felony, four to 15 years of incarceration, revocation of driver's license for life; with 0.16 BAC - mandatory minimum $5,000 fine.
  • Sixth or subsequent DUI - Class X felony, six to 30 years of incarceration; with 0.16 BAC - mandatory minimum $5,000 fine.

A third or subsequent DUI committed while a child under the age of 16 is in the vehicle will result in an additional mandatory fine of $25,000 and 25 days of community service.
