Charges and Penalties for Public Indecency in Illinois

In Illinois, you commit the crime of public indecency if you are 17 years of age or older and perform any act in a public place, where it is reasonably expected to be viewed by others, involving such sexual conduct as:

  • Public sexual penetration (intercourse), or sexual conduct, clothed or unclothed.
  • Lewd exposure of your body with the intent to arouse or satisfy sexual desire.

Children under the age of 17 cannot be charged with public indecency, but may be charged, as juveniles, with disorderly conduct.

Public indecency is generally a Class A misdemeanor. However, if you are convicted of a third or subsequent offense of public indecency, you will be charged with a Class 4 felony. It is also a Class 4 felony if you are 18 years of age or older, and the sexual acts take place within 500 feet of elementary or secondary school grounds, when children are present on the grounds.

Depending upon the circumstances of your offense, you could be sentenced to one year in jail and a maximum fine of $2,500 if found guilty of public indecency.
