Overweight Violations in Illinois
The state of Illinois places strict limits on the allowable weight of commercial vehicles, with trucks allowed to carry a maximum of 20,000 pounds per single axle, 34,000 pounds per tandem axle, and 80,000 pounds of total weight for vehicles with five or more axles. A violation occurs when a truck exceeds the weight limit per axle or the total gross weight, and this can result in the following penalties:
- Up to 2,000 pounds overweight: $100 fine
- 2,001 to 2,500 pounds overweight: $270 fine
- 2,501 to 3,000 pounds overweight: $330 fine
- 3,001 to 3,500 pounds overweight: $520 fine
- 3,501 to 4,000 pounds overweight: $600 fine
- 4,001 to 4,500 pounds overweight: $850 fine
- 4,501 to 5,000 pounds overweight: $950 fine
- More than 5,000 pounds overweight: $1,500 fine, plus a $150 fine for each additional 500 pounds overweight
Four or more overweight violations within one year will result in a $5,000 fine for the fourth violation and every additional violation.
While an overweight violation is considered a moving violation, it is not a criminal charge, and it is not considered a serious violation that can result in CDL disqualification. Overweight violations will not add "points" to a driver's record that could result in the suspension of their driver's license.
