DUI Penalties in Illinois

Driving under the influence with a BAC of 0.08%, a THC (cannabis) concentration of more than 5 nanograms per milliliter of whole blood or 10 nanograms per milliliter of another bodily substance, or any controlled substances in your system can cost you a lot of money. For a Class A misdemeanor DUI, the state can impose the following penalties:

  • For a first offense - Suspension of vehicle registration and revocation of driver's license for one year.
  • For a second offense - A mandatory minimum term of either five days of imprisonment or 240 hours of community service, suspension of vehicle registration, and revocation of driver's license for five years.
  • First offender DUI while transporting a child under the age of 16 - An additional six months of imprisonment, an additional mandatory $1,000 fine, and 25 days of community service in a program benefiting children.
  • First offender DUI with BAC of 0.16% - A mandatory minimum of 100 hours of community service and mandatory minimum $500 fine.
  • Second DUI with BAC of 0.16% - A mandatory two days in jail and mandatory minimum $1,250 fine.

When you are charged with a DUI under circumstances that involve repeat and felony DUI charges, such as driving with no license or driving on a revoked license, DUI resulting in an accident or injury, DUI resulting in serious bodily harm, or DUI resulting in death, you will face aggravated felony charges. DUI felonies range from Class 4 to Class X with penalties from a five-year license revocation to permanent revocation, 240 hours to 25 days of community service, one to 25 years in jail and up to $25,000 in fines.
